A Constituição de 1838 institui, pela primeira vez, a existência de um Tribunal de Contas, como órgão independente de controlo das finanças públicas.

Artº 135º
"Haverá um Tribunal de Contas, cujos Membros serão eleitos pela Câmara dos Deputados.
§ 1º - Pertence ao Tribunal de Contas verificar e liquidar as contas da receita e despesa do Estado, e as de todos os responsáveis para com o Tesouro Público.
§ 2º - Uma lei especial regulará a sua organização e atribuições."
The 1838 Constitution established, for the first time, the existence of a Tribunal de Contas, as an independent body for the public finance control.

"A Tribunal de Contas shell be created, and its Members elected by the Chamber of Deputies.
§ 1º - The Tribunal de Contas shall be in charge of verifying and setting the State revenue and expenditure accounts, as well as those of all persons responsible for the Public Treasury.
§ 2º - A special law shall rule its organization and further competencies."
